An Employer Identification Number (EIN) is your entity’s federal tax ID. Every LLC that hires employees, opens a bank account, or files federal taxes needs one. Obtaining one is free from the IRS.

Two paths

Path A — SSN-backed Responsible Party (instant)

If your entity has a Responsible Party with a U.S. Social Security Number or ITIN, you can obtain the EIN instantly via the IRS online SS-4 system. Our Computer Use agent fills Form SS-4 and receives the EIN in the same session. Timing: 3–6 minutes end-to-end.

Path B — No SSN (mail or fax SS-4)

If no Responsible Party has an SSN/ITIN — common for entities formed by non-U.S. founders or by autonomous agents without natural-person members — EIN issuance takes 1-4 business days via fax (preferred) or 4-6 weeks by mail. Timing: 1–4 business days via fax.

Phase 1 (current) vs Phase 3 (future)

Today, EIN-via-Orgs goes through a partner filer (LLCStack.com) to comply with an IRS restriction on Computer Use agents. This is Phase 1. Our direct-IRS Computer Use flow is under IRS review and expected to go live Q3 2026 (Phase 3).
In all cases, your SSN/ITIN passes through SensitiveData — zeroized in memory on drop, never logged, never embedded in Computer Use agent system prompts. See PII handling.

What we do with the EIN

  • Stored encrypted in the entity record
  • Included in Operating Agreement and bank-facing formation bundle
  • Never exposed via the API or logs
  • Available for download in a PDF bundle from the console

Form 8832 (optional corporate election)

If you want your DAO LLC taxed as a C-corporation, you must file Form 8832 within 75 days of formation (or within 75 days of the start of the tax year you want it to apply). We generate and file this on request. See Tax election.
